TERMS OF SERVICE

1. Acceptance of Terms

By accessing or subscribing to the services provided by Infiltrate Marketing, including our software-as-a-service (SaaS) platform, GoHighLevel sub-account infrastructure, and Build Team technical and creative execution services (“Services”), you (“Client,” “User,” or “you”) agree to be bound by these Terms of Service.

2. Subscription Plans & Included Build Team Hours

Platform access requires an active subscription tier along with a one-time onboarding setup fee. Each tier includes a recurring monthly allocation of Build Team technical and creative hours:

3. Build Team Hours, Packages & Surcharge Structure

A. Build Team Scope

Build Team hours may be used for custom web design, funnel construction, ad creative design, workflow automation, CRM configuration, form/survey setup, and general technical execution.

B. Additional Hour Refill Packages

Clients with an active subscription plan may purchase standalone hour refills at tiered rates:

  • 1 Hour (Essential Fix): $60 total ($60.00 / hr)
  • 6 Hours (Booster Pack): $299 total (~$49.83 / hr)
  • 15 Hours (Power Pack): $675 total (~$45.00 / hr)
  • 25 Hours (Max Pack): $999 total (~$39.96 / hr)

C. Rollover Terms

Build Team hours (both monthly plan allocations and purchased refill packs) do not expire as long as an active platform subscription is maintained. Hours roll over indefinitely. If a subscription is canceled, any remaining unspent hours are forfeited upon account termination.

D. Surcharge Multipliers (1.20x Rates)

All standard Build Team hours consume time on a 1.00x basis (1 hour worked = 1 hour deducted from balance). The following conditions automatically trigger a 1.20x multiplier against your hour balance (1 hour worked = 1.20 hours deducted):

Note on After-Hours & Business Closures: The 1.20x surcharge automatically applies to all work requested or executed within the Friday 2:00 PM to Sunday 12:00 AM window, as well as any official holiday or day the business is designated as closed according to the Infiltrate Marketing Operational Calendar (referencing our operational calendar). Clients may request a copy of the current calendar at any time.

  • Non-Cumulative Rule: Rate multipliers do not stack unless explicitly agreed upon in writing (e.g., specialized content produced during a business closure remains at the 1.20x multiplier).
  • Tracking Increments: Build Team tasks are tracked and deducted in 15-minute increments. Detailed time logs will reflect any 1.20x multipliers applied.

4. Payment Terms & Automatic Renewal

  • Billing Cycle: Monthly platform subscription fees are billed automatically every 30 days via the payment method on file. Setup fees are due prior to initial onboarding.
  • Additional Hours: Hour refill packs are billed immediately upon order.
  • Payment Failures: If recurring subscription charges fail and remain past due beyond 5 business days, Build Team services will be paused and GHL sub-account access suspended until settled.
  • Refund Policy: All SaaS subscription fees, setup fees, and purchased Build Team hours are strictly non-refundable once activated or billed.

5. Acceptable Use & Telecom Compliance

  • Messaging Rules: You are solely responsible for ensuring compliance with TCPA, CAN-SPAM, GDPR, and carrier requirements (including A2P 10DLC registration).
  • Prohibited Content: Automated messaging or funnel content related to illegal activities, deceptive financial offers, adult content, or unsolicited bulk messaging is strictly forbidden. Infiltrate Marketing reserves the right to suspend non-compliant sub-accounts immediately.

6. Intellectual Property & Service Outages

  • Platform Infrastructure: Infiltrate Marketing retains rights to core platform systems, proprietary software integrations, and agency templates.
  • Deliverables: Clients hold full rights to custom web designs, ad graphic assets, and funnels created specifically for them using paid Build Team hours.
  • Third-Party Providers: Infiltrate Marketing is not responsible for platform interruptions or deliverability issues caused by underlying third-party vendors (e.g., GoHighLevel, Twilio, Stripe, Mailgun).

7. Amendments & Governing Law

These Terms are governed by state registration laws. Infiltrate Marketing reserves the right to adjust plan features, package pricing, or terms by publishing an updated version to the site. Continued platform usage constitutes acceptance of all updated terms.
